Mr. Small is a 1965 graduate of Emory University
and a 1969 honor graduate of the School of Law
at Mercer University. He was Executive Editor
of the Mercer Law Review and received various
course honors, including the law school's trial
practice award.
Mr. Small represents creditors and other parties
in commercial jury and non-jury litigation cases
and various arbitration tribunals. He has participated
as lead counsel in trials involving issues of
lender liability, secured and unsecured creditor
rights, construction lien law, and receivership
and bankruptcy law. He has also served as Trustee
and counsel for the Trustee in both Chapter
7 and Chapter 11 cases, has been legal counsel
to a number of court appointed creditors' committees
and has represented debtors and debtors-in-possession.
Mr. Small, one of the founders of the Atlanta
Bar Association's section on Bankruptcy, has
served as President and Chairman of the Board
of the Southeastern Bankruptcy Law Institute
and as Chairman of the sections on Bankruptcy
of the Atlanta Bar Association and the State
Bar of Georgia. He also served as an adjunct
professor of bankruptcy law at Mercer Law School,
and has extensively lectured and written on
the subject of bankruptcy and commercial law.
Mr. Small has been included in The Best Lawyers
in America for over ten years; and has been recognized
for many years as a Georgia "Super Lawyer" by legal
publisher Law & Politics. He served as a First Lieutenant
in the United States Army from 1969-1971. During
1970-1971, Mr. Small was assigned to the Headquarters
Unit of the 937th Combat Engineer Group in Phu Tai. South Viet Nam.
